Doctoral thesis titled ”Liability for the quality of product sold“ analyzes two significant legal institutes: liability for defective product (non-compliant product) and warranty, which serve as mechanisms to safeguard the principle of equal consideration in bilateral contracts made by onerous title. The first part of the thesis delves into the historical development of the institute of liability for defective products, providing a detailed analysis of relevant legislation in the Republic of Serbia, the legal system of Bosnia and Herzegovina, and foreign jurisdictions. Furthermore, the author conducted in-depth research on the legislation that governs international sales of goods, covering topics such as the assumption of liability for material defects and the contents of seller's liability. She specifically referenced contentious issues and case law relevant to this matter. The second part of the thesis focuses on consumer protection, especially in the context of Community law. The author conducted an analysis of the most significant EU legal instruments that govern the liability for non-compliant products, scrutinizing their transposition into national legislation of Member States, their impact on the liability institute for defective products, and the degree of alignment between the current consumer protection legislation in Serbia and Bosnia and Herzegovina and Community law. The third part of the thesis focuses on the features, significance, and regulation of the institute of warranty in the laws of Serbia, Bosnia, and Herzegovina, as well as in comparative law. In addition to the issues of liable party, assumption of liability, and content of liability, the thesis points to similarities and differences with respect to the institute of liability for material defects in goods. The author considers the necessity of having these institutes in the legal systems of Serbia and Bosnia and Herzegovina, as well as the possibility of their adjustment to the EU legislation in order to safeguard the interests of consumers.
Doktorska disertacija pod nazivom „Odgovornost za kvalitet prodate stvari“ analizira dva važna pravna instituta: odgovornost za materijalne nedostatke (nesaobraznost robe) i garanciju, kao instrumente zaštite načela ekvivalentnosti uzajamnih prestacija kod dvostrano obaveznih, teretnih ugovora. U prvom dijelu rada, istražuje se istorijski razvoj instituta odgovornosti za materijalne nedostatke, te detaljno analizira njegova regulativa u pravu Republike Srbije i pravnim sistemima u BiH, inostranom pravu, kao i prema propisima koji uređuju međunarodnu prodaju robe, počev od pretpostavki odgovornosti za materijalne nedostatke, preko sadržine odgovornosti prodavca, uz ukazivanje na sporna pitanja kao i stavove sudske prakse vezane za ovu problematiku. Drugi dio rada fokusiran je na zaštitu prava potrošača, posebno u kontekstu prava Evropske unije. Ovaj dio analizira najznačajnije propise EU koji regulišu materiju odgovornosti za nesaobraznost robe ugovoru, njihovu implementaciju u nacionalna prava, njihov uticaj na opšti institut odgovornosti za materijalne nedostatke kao i usklađenost aktuelnih zakona o zaštiti potrošača u Srbiji i BiH sa komunitarnim pravom. Karakteristike, značaj, te način regulisanja instituta garancije u srpskom i bosansko-hercegovačkom pravu, kao i u uporednom pravu predmet su trećeg dijela disertacije. Pored odgovornih lica, pretpostavki odgovornosti, sadržine odgovornosti, u radu se ukazuje na sličnost, kao i na razlike u odnosu na institut odgovornosti za materijalne nedostatke. Razmatra se neophodnost postojanja ovih instituta u pravnim sistemima Srbije i BiH, kao i mogućnost njihove izmjene i prilagođavanja propisima Evropske unije sa ciljem podizanja nivoa zaštite potrošača.
